Terms and Conditions for Ecospace Explorers
By booking a tour with Ecospace Explorers, you agree to the following terms and conditions:
1. Booking Confirmation:
All tour bookings are considered confirmed only after receiving full payment or a deposit as specified by Ecospace Explorers. Upon confirmation, you will be provided with a booking reference number and all relevant details regarding your tour.
2. Tour Itinerary:
Ecospace Explorers will make every effort to adhere to the planned tour itinerary. However, please note that unforeseen circumstances such as adverse weather conditions, natural disasters, political unrest, or other uncontrollable factors may require itinerary changes.
Ecospace Explorers reserves the right to modify the itinerary, substitute accommodations/attractions, or cancel a tour if necessary. Such changes will be communicated to you as soon as possible, and alternative options will be offered.
3. Eligibility and Fitness:
It is your responsibility to ensure that you meet the eligibility requirements specified for the tour, including age restrictions, health conditions, and physical fitness. Some tours may involve strenuous activities or require specific certifications (e.g., diving tours). It is important to assess your capabilities and consult with your healthcare provider if necessary before booking a tour.
4. Travel Documents and Insurance:
It is your responsibility to carry and provide all necessary travel documents (e.g., valid passport, visas, immunization certificates) required for the tour. Ecospace Explorers will not be held liable for any inability to participate in the tour due to inadequate or missing documents.
Additionally, we strongly recommend obtaining comprehensive travel insurance to cover any unforeseen incidents, medical emergencies, or trip cancellations.
5. Customer Conduct:
While on tour, you are expected to behave responsibly, respect local customs, and follow the instructions of the tour guide. Any disruptive behavior that may pose a risk to others’ safety or hinder the smooth operation of the tour may result in your removal from the tour at your own expense, without any entitlement to a refund.
6. Assumption of Risk:
Participating in adventure tours or activities carries inherent risks. By booking a tour with Ecospace Explorers, you acknowledge and accept these risks, including but not limited to personal injury, property damage, illness, and potential loss or theft of personal belongings. You agree that Ecospace Explorers and its staff will not be held liable for any such incidents.
7. Limitation of Liability:
Ecospace Explorers will exercise reasonable care and diligence in providing tour services. However, we will not be responsible for any losses, damages, accidents, delays, or expenses resulting from circumstances beyond our control, including force majeure events. In no event shall Ecospace Explorers be liable for any indirect, consequential, or incidental damages.
8. Photography and Marketing:
During the tour, Ecospace Explorers may capture photos or videos for marketing purposes. By participating in the tour, you grant Ecospace Explorers the right to use your likeness, images, or testimonials in promotional materials unless otherwise specified in writing.
9. Complaints and Disputes:
If you have any complaints or disputes during the tour, please notify your tour guide or contact Ecospace Explorers’ customer support immediately. We will make reasonable efforts to resolve the issue promptly and amicably.
10. Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed in accordance with the laws of Uganda. Any disputes or claims arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of law in Uganda.
